A two-year old child is in the custody of child services after his mother was arrested early Friday morning on charges of neglect of a dependent.

The case began at approximately 1:10 a.m. Friday when Whitley County dispatch received a telephone call about a child left unattended in a car that wasn't running.

Whitley County Sheriff's deputy Marcus Gatton was advised the vehicle was in a private drive in the east 6200 block of county road 400S.

Gatton advised dispatch he would hurry to the site for the child's safety due to the extremely low temperatures. In his report, Gatton noted the temperature on a sign outside Kelley Cheverolet read 12 degrees.

Upon his arrival, Gatton found the calling party who told him the baby was in the back seat crying.

"I confirmed the vehicle wasn't running and started to open the vehicle's front door," Gatton said.

As he was opening the door, the deputy noticed a male and female coming from the residence.

When Gatton opened the front door, he felt no warmth or heat coming from inside the car and it was cold inside.

The baby was cold to touch on his bare hands which were red in color.

The child was still crying and Gatton radioed for an ambulance to check his condition. While he was doing this, Indiana State Trooper Joel Lemmon arrived and took the baby inside his squad car to keep him warm until the ambulance arrived.

The baby was wearing pajamas and a coat.

The rear window of the car had frost on it behind the point the baby had been sitting.

Gatton questioned the mother, Jennifer Hyser, why the child was left alone in the car and she replied he was only alone for a few minutes.

She told Gatton she had just arrived from her job in Warsaw, but when deputies checked the engine manifold with their bare hands, it wasn't warm. The upper radiator hose was also checked and it was barely lukewarm.

Hyser was taken into custody, but is free on bond until her court hearing.
